  Intermediate Care Facilities for Persons with Intellectual Disabilities - Reimbursement Methodology (LAC 50:VII.32903)

  Amends the provisions governing reimbursement for non-state intermediate care facilities for persons with intellectual disabilities in order to increase the rate reimbursement rates to facilities that downsized from over 100 beds to less than 35 beds prior to December 31, 2010 without the benefit of a cooperative endeavor agreement, in compliance with Act 1 of the 2020 First Extraordinary Session of the Louisiana Legislature.

  Programs and Services Amendments Due to the Coronavirus Disease 2019 (COVID-19) Public Health Emergency -- Home and Community-Based Services Waivers and Long-Term Personal Care Services

  Amends the provisions governing the Adult Day Health Care Waiver, the Community Choices Waiver, and Long-Term Personal Care Services throughout the Coronavirus Disease 2019 (COVID-19) public health emergency declaration, and clarifies that the Home and Community-Based Services waiver provisions which correspond to Louisiana's section 1915(c) Appendix K waiver will remain in effect for the duration of the Emergency Rules published in the April 20, 2020 edition of the Louisiana Register or until the Appendix K waiver termination date of January 26, 2021, whichever is later.

  Programs and Services Amendments due to the Coronavirus Disease 2019 (COVID-19) Public Health Emergency

  The Department of Health, Bureau of Health Services Financing, amends Title 50 of the Louisiana Administrative Code in order to enact temporary provisions to ensure the continuation of essential programs and services throughout the duration of the Coronavirus Disease 19 (COVID-19) public health emergency declaration.

  The Louisiana Department of Health Issues Revised Order for Medical and Surgical Procedures

  Today, the Louisiana Department of Health issued a revised order for medical and surgical procedures. This guidance is necessary during a public health emergency to preserve personal protective equipment, to properly utilize hospital staffing and to ensure adequate hospital bed capacity.

  Amendments to Additional Programs and Services Due to the Coronavirus Disease 2019 (COVID-19) Statewide Public Health Emergency

  In response to the Coronavirus Disease 2019 (COVID-19) public health emergency declarations and the rapid advancement of COVID-19 throughout Louisiana, the Department of Health, Bureau of Health Services Financing, the Office of Aging and Adult Services (OAAS), and the Office for Citizens with Developmental Disabilities (OCDD) further amend Title 50 of the Louisiana Administrative Code in order to temporarily adopt additional provisions to ensure the continuation of essential programs and services, and to rescind and replace the nursing facility add-on provisions of the previous COVID-19 Emergency Rule in order to clarify the eligible nursing facility providers.

  Amendments to Programs and Services Due to the Coronavirus Disease 2019 (COVID-19) Statewide Public Health Emergency

  In response to the Coronavirus Disease (COVID-19) public health emergency declarations and the rapid advancement of COVID-19 throughout Louisiana, the Department of Health, Bureau of Health Services Financing, the Office of Aging and Adult Services (OAAS), and the Office of Behavioral Health (OBH) amend the provisions of Title 50 of the Louisiana Administrative Code in order to adopt temporary measures to provide for the continuation of essential programs and services to ensure the health and welfare of the citizens of Louisiana in accordance with the provisions of the Administrative Procedure Act, R.S. 49:953(B)(1) et seq.

  Dental Benefits Prepaid Ambulatory Health Plan - Network Provider Reimbursement LAC 50:I.2111

  Amends the provisions governing the dental benefits prepaid ambulatory health plan in order to increase reimbursement for dental exams for children under three years of age and restorative dental services in compliance with Act 10 of the 2019 Regular Session of the Louisiana legislature.

  Adopts provisions governing coverage of telemedicine during a declared disaster.

• December 27, 2019

  Medical Transportation Program – Non-Emergency Medical Transportation LAC 50:XXVII.541

  Amends the provisions governing provider enrollment in the non-emergency medical transportation (NEMT) program in order to lower the minimum liability insurance coverage requirements and reduce insurance premiums paid by NEMT providers to sustain and increase provider participation in the NEMT program. This Emergency Rule also removes language referring to prepayment of premiums from the administrative Rule to align with current practices.

  Therapeutic Group Homes - Licensing Standards – Criminal Background Checks LAC 48:I.6210

  Continues the provisions of the September 20, 2019 and December 20, 2019 Emergency Rules which adopted provisions governing the licensing of therapeutic group homes (TGHs) in order to comply with federal criminal background check and Department of Children and Family Services abuse/neglect registry check requirements.

  Nursing Facilities – Licensing Standards – Virtual Visitation LAC 48:I.9781

  Continues the provisions of the November 20, 2018 and December 20, 2019 Emergency Rules which amended the provisions governing the licensing of nursing facilities to adopt provisions governing virtual visitation in order to provide for consent, by a nursing facility resident or a legal representative, relative to the authorization for installation and use of a monitoring device in the room of the resident in compliance with Act 596 of the 2018 Regular Session of the Louisiana Legislature.
