Medicaid Rulemaking
This web page contains historical administrative rulemaking documents promulgated by the Louisiana Department of Health (LDH), Bureau of Health Services Financing (BHSF) and officially published in the Louisiana Register and then compiled into the Louisiana Administrative Code (LAC) Titles 48 and 50. Title 48 of the LAC contains the rules governing the licensing and/or certification of health care facilities/programs. Title 50 of the LAC contains the rules governing the administration of the Louisiana Medicaid Program. All rules promulgated by the LDH/BHSF can be found on the Office of State Register's website.

Repeals LAC 50:III.505 to align with recent legislative changes enacted through Act 427 of the 2025 Regular Session, which prohibits the department from accepting Medicaid eligibility determinations made by a Federally-Facilitated Exchange, including the Federally-Facilitated Marketplace.

Amends the provisions governing reimbursement methodology for ICFs/IID to remove the deadline for sending out payments and remove language that limited which facilities were eligible to those active and enrolled on the date of payment. This will provide the department with greater flexibility in distributing payments and will allow facilities to qualify based on the original eligibility date of July 1, 2024.

Amends the provisions governing children and adult mental health services to expand the provider types authorized to render therapeutic services. This proposed rule would allow Medicaid to pay for therapy services provided by psychology interns in approved American Psychiatric Association internship programs, as well as by provisionally licensed psychologists. This is being done in accordance with Senate Concurrent Resolution 10 of the 2024 Regular Legislative Session.

Louisiana Children’s Health Insurance Program - Notice of Intent
Amends Medicaid eligibility provisions to align with federal requirements related to citizenship and satisfactory immigration status. In accordance with the 2025 Budget Reconciliation Act (House Resolution 1 of the 119th Congress), beginning October 1, 2026, Medicaid and the Children’s Health Insurance Program eligibility will be limited to individuals whose citizenship or immigration status qualifies them for federal financial participation.
